Abstract
Terrorist acts represents one of the most dangerous crimes nowadays because of the physical, financial, or moral damage they cause. This damage does not affect one personbut hundreds of people. What complicates the situation is the fact that these actions are carried out by unknown persons whose lives end upon the execution of the terrorist act, which is why the injured does not get a compensation from the perpetrator of the terroristact. Concerning the failure of general rules to compensate those affected by terrorist acts,the Iraqi legislator emphasized in the revised law of compensation for those affected by war operations, military errors and terrorist operations No.20 in 2009 that compensation is a right of the injured that can claim it from the state. However, what is the legal basis for this obligation? Is it tort liability or something else? In order to explain all the issues stated above we divided this study into three sections: first, the concept of terrorist actionand those affected by it; second, the basis of compensation law for those affected by the terrorist act; and third, evaluation of the view of the Iraqi legislation regarding the state’sobligation to compensate those affected by the terrorist act.
