Abstract

السند الرسمي نوعان: إما موثق أو سند منظم. وتختلف هذان النوعان من حيث قوة الإثبات. في السند الرسمي المنظم، يقوم الموظف العام أو المكلف بالخدمة العامة بتوثيق الوقائع المادية في السند، مما يعني عدم جواز إنكار هذه الوقائع مستقبلاً، بعكس السند الرسمي الموثق، حيث يقوم الموظف بتوثيق التوقيعات فقط دون التحقق من صحة البيانات والإقرارات الواردة فيه. وللتوضيح، تم تناول هذا الموضوع من خلال مطلبين: الأول يتناول تعريف السند الرسمي المنظم، بينما الثاني يناقش آثار السند في مجال الإثبات وأثره في الحجز الاحتياطي. وفي ختام البحث، تم عرض أهم النتائج التي توصلنا إليها والمقترحات المتعلقة بالبحث." "The official bond is of two types: it is either a documented bond or a structured bond. Both documents are issued by a public official or a person charged with a public service, but they differ in terms of the strength of proof. The regulating official document is the strongest in evidence because the employee records material facts in the official document, which means that these facts may not be denied in the future, unlike the notarized official bond under which the employee certifies signatures only without checking the validity of the data and declarations contained therein. For the purpose of briefing on this subject, we addressed it through two sections. The first section discusses the concept of the formal, structured chain of transmission, while the second section covers the effects of this chain of transmission. We concluded the research with a conclusion in which we summarized the most important results we reached and our main suggestions regarding the research.
